Justice Sotomayor will not participate next month when the US Supreme Court hears one of two cases that could change a key element of the system America uses to elect its president — the Electoral College.

Baca, a former state senator, has been Sotomayor's friend for decades. Baca's sister and brother-in-law lived for a time in Sotomayor's New York apartment, and Baca herself had a prominent spot at the justice's Senate confirmation hearing.

Sotomayor's recusal is unlikely to make any practical difference. Even if the justices turned out to be divided 5-4 in the Colorado case, her absence would result in a 4-4 tie, meaning the outcome would have no legal significance; her participation in the other case would count, however, and it would be the controlling decision.

Weird for a Supreme Court judge to throw a tantrum like this. Does she still get paid for not showing up to work? Can we impeach and remove her from the court?

America needs the Electoral College.

They shouldn’t be hearing cases involving “faithless electors”. They should be hearing a case for removing the electoral college!

Kavanaugh is friends with trump so he should sit out on case about trumps tax returns right?

Let see ... senators who declared they had no intention to be unbiased and others who were actually witnesses got to judge wether trump was guilty but this SCOTUS judge must recuse. Why even argue the merits when we know the outcome?

Read the article and she did the right thing. Not sure the outcome will be but I wish more would do the same.

You don’t see much integrity on the left. Do I believe she could judge the case objectively? No, but that’s because she doesn’t judge any case objectively. Even so. I do respect her for this decision. It is refreshing to see some integrity in DC.

If anything there should be no electoral college.. But.. When it gets to the electoral college, you have to respect the will of the people.. They didn't vote for your personal choice, they voted an you represent that vote.. You personal opinions meaning nothing at that stage..
