According to James' defense attorney Russ Hunt Jr., there is a "huge amount" of evidence, known as discovery, to go through from the multiple incidents in Bexar and Travis counties. Bexar County, where James allegedly killed his parents, recently filed charges and began providing their evidence to Travis County.
It remains undecided which county will take the lead in prosecuting James, who faces four capital murder charges that could make him eligible for the death penalty if convicted. Hunt said there are many ways the case could be split up, such as consolidating all charges into one trial in Travis County or holding separate trials in each jurisdiction. Those decisions will primarily be made by the judges and prosecutors involved.
James, a 35-year-old college graduate and military veteran, was arrested in Austin last December following a string of violence that left six people dead and three injured, including two police officers. He is accused of killing his parents near San Antonio before driving to Austin, where four more people were killed.Hunt described James as respectful and intelligent, but said he is in a "very stressful situation.
With such an expansive case, Hunt was hesitant to estimate when a trial might take place, saying he "wouldn't want to hazard a guess."
