Agreement in lawsuit would allow development in South Morro Hills

A proposed settlement between the grass-roots environmental group Preserve Calavera and the developer Integral Communities would allow the 585-home North River Farms project in the rural South Morro Hills area of Oceanside to proceed.

Preserve Calavera filed its lawsuit Dec. 9, 2019, claiming the environmental impact report for the development was inadequate, and that the project would reduce public safety, increase greenhouse gases and bring the permanent loss of prime farmland. However, Integral Communities filed a lawsuit claiming the referendum was preempted by Government Code 66300, which the Legislature passed in 2019 to address the statewide housing shortage. A Superior Court judge upheld the developer’s claim in May 2021, and ruled that the referendum was invalid.North River Farms project manager Ninia Hammond did not respond to an email Friday requesting comment.
