Prosecutor Thomas Binger said that the comment demonstrated racial bias and the state asked that the juror be excused.
“I wanted to see if that was accurate or not,” the judge told the juror, and asked if he wanted to repeat or discuss the remark further.“My feeling is, it was nothing to do with the case. It wasn’t anything to do with Kyle and his seven charges,” the juror said, without repeating his original comments.
“Even at the most, it was bad judgment to tell a joke of that nature,” he said. Schroeder said the public needs to be confident the trial is fair.
