Record Number of Abortion Restrictions Passed This Year, Group Says

Ninety abortion restrictions have been enacted in 2021 -- the most in one calendar year since the U.S. Supreme Court legalized abortion with Roe v. Wade in 1973, according to a study from theThe 90 restrictions were passed during the first six months of the year. The previous record was 89 abortion restrictions passed during the whole of 2011, the study says.

"We're really trying to bring attention to the fact that state legislatures are moving very quickly on abortion bans and restrictions," Elizabeth Nash, a co-author of the report, said in an interview withThe study called attention to legislation such as the Texas “fetal heartbeat” law that bans abortion after six weeks -- when many women don’t even know they’re pregnant -- with limited exceptions.

The Guttmacher study says the Texas law has “a new, uniquely cruel twist.” People can now sue an abortion provider or even a person who helps somebody obtain an abortion by providing transportation or other aid, the study says. The person who initiates the lawsuit doesn’t have to know the person who got the abortion, the study said.The anti-abortion legislation is troubling, the Guttmacher Institute says, because the U.S.

Since the law passed, lower federal judges have ruled it was unconstitutional because of Roe v. Wade. That 1973 Supreme Court case says states don’t have the right to ban abortions before fetal viability, which is usually considered to be around 24 weeks,"It's deeply concerning to see the Supreme Court take this case," Nash said to NPR."Even by taking the case, the court is signaling that they could undermine abortion rights.
