In August 2014 the University of Tennessee-Chattanooga deemed student Corey Mock guilty of sexual assault, finding that in the disputed encounter he failed to prove he had obtained “affirmative consent” from the accuser. According to Mr.
Mock’s unrebutted testimony, the female student’s actions during intercourse led him to believe that she had consented to sex. Mr. Mock sued the school, and a Tennessee judge ruled in his favor. “Affirmative consent,” the judge wrote, “is flawed and untenable if due process is to be afforded.” The standard “erroneously shifted the burden of proof” to the accused.
opinion kcjohnson9 staylor5448 As 'To Kill a Mockingbird' shows, this is hardly a new system. It was the de facto one in the old south, at least when the accused was black. But I'm sure it wouldn't *possibly* be abused *this* time.
opinion kcjohnson9 staylor5448 Frightening! The basis of the American justice system is that it would rather see a guilty person go free than put an innocent one in prison. That will be reversed. More innocent people will be convicted- and that number is too high already. All to satisfy the angry mob.
opinion kcjohnson9 staylor5448 Did any of you notice that this will apply to women too? People who are claiming to be feminists are demanding that women lose their fundamental rights.
opinion kcjohnson9 staylor5448 No.
opinion kcjohnson9 staylor5448 This is outrageous. Don’t say wokeness is just a Twitter fad.
opinion kcjohnson9 staylor5448 Really interesting guilty until proven innocent
opinion kcjohnson9 staylor5448 The first thing should happen after that is everyone go accuse these activists of gang raping every American
opinion kcjohnson9 staylor5448 WTF!? The Left supposedly hate Nazi’s yet they sure seem to love their system eh.
opinion kcjohnson9 staylor5448 Remarkable. Guilty till proven innocent is absurd.
opinion kcjohnson9 staylor5448 Well now that sounds unconstitutional.
opinion kcjohnson9 staylor5448 When one party claims consent and the other claims non-consensual assault, why shouldn’t the burden of proof be on the one claiming consent? That is the way it is in other types of assault.
opinion kcjohnson9 staylor5448 Umm no thanks
opinion kcjohnson9 staylor5448 Guilty until proven innocent! Unconstitutional! Me too - too far!
opinion kcjohnson9 staylor5448 it's like something out of Sovjet, of course it wasn't limited to sex only back then.
opinion kcjohnson9 staylor5448 Hope this goes through and is adopted worldwide.
