“He walked out of that store, and 19 minutes later, after his initial encounter with the police officers, he would be transported on a gurney to the hospital,” state prosecutor Duane Lyons said during closing arguments. “He said to the police officers several time, ‘I can’t breathe.’” Lyons said, referencing McClain’s words captured on body-camera footage.
The defense rested earlier this week without calling any witnesses. Instead, they questioned the prosecution’s witnesses, seeking to chip away at their arguments and place blame on the paramedics — and at times, the other co-defendant.The trial stems from an August 2019 encounter where police were responding to a 911 call that reported McClain as looking “sketchy.” McClain, a massage therapist who lived near the area where he was stopped, had been walking home from a convenience store.
