that when he signed on to the case earlier this summer, he also believed the shooting to be a case of justifiable self-defense.
The 16-member grand jury had access to far more information than what was available at the time of the district attorney's initial decision, according to Franklin. He said Omaha police continued the investigation, conducting roughly 60 interviews and acquiring video clips from the public, which they passed on to Franklin's team.
He said the terroristic threat count applies to Gardner's conduct in a verbal back-and-forth with Scurlock, and implied that Gardner was threatening the use of deadly force in the absence of receiving any such threats himself. The use of a firearm in connection with a felony charge is related to the manslaughter charge, Franklin said, noting"that particular count does not rest solely on an analysis of the video that has been played in the media already."
DO NOT DEFEND YOURSELF AGAINST BLM TERRORISTS! The government has bent the knee to the mob.
NPR just more fake news and Marxist radical trash writing (not journalism)
James deserved it either way
Why?
Again, you put the race in your article when it fits the script that you want to push. defundNPR
It should not have taken the appointment of a Special Prosecutor to pursue this. DA failed to do his job.
At least some good news today.
Did anyone in this comment section actually read what happened before and during the altercation. Defense of private property is a pillar of basic human rights
Once it gets to the jury he will get off.
You can indict a ham sandwich
Can we now get Gardner a conviction, life without parole, and distribution of all his assets to the Scurlock family?
Is this the case ?
I am so pissed that my tax dollars fund the NPR
It’s so nice they gave him a choice if either turning himself in or face a arrest warrant! Why aren’t police busting down him door and hauling his ass to jail?
This is one of the reason most states don't use Grand Juries anymore. The defense is not allowed to present a case & the prosecutor can pick & choose what they want to present-It prejudices the case from the very onset & that's fault of the system not the jurors
Exactly what needed to happen to this racist! Just the first step towards justice for the Scurlock family.
Now do cops
This will never be enough justice for the loss to James’ family.
why is 'black' capitalized and 'white' lowercase?
Murder is murder and Nebraska has no stand your ground law. This needed to happen. And hopefully charges follow.
Good!
Justice. Let him face the jury he never gave his victim a chance to.
Need some convictions.
Good
