OAKLAND — In a rare legal maneuver, an Oakland man was allowed to withdraw his 2014 guilty plea to first degree murder charges, and plead to a lesser count, after complaining he didn’t receive the early chance for parole that he expected.to first degree murder in the 1987 sexual assault and strangulation of 28-year-old Roshun Broadnax.
On March 21, 2022, Brown waived his right to an initial parole hearing, but he is scheduled to go before the board on March 2023, records show. It is unusual for a defendant to be allowed to withdraw a guilty plea, but Brown’s attorneys convinced Judge Morris Jacobson to approve a defense motion that argued Brown never would have accepted the 2014 plea deal if he’d known how much time he would do.
Instead, when Brown was transferred to state prison he learned the California Department of Corrections and Rehabilitation intended to have him serve the full 25 years, court records show. Oakland police reopened the case in 2012 and submitted a profile of DNA found under Broadnax’s fingernails to the state database of convicted felons. Brown’s DNA was in the database due to a 1973 rape conviction.
