The man who as a 4-month-old appeared nude on the 1991 cover of Nirvana’s album “Nevermind” has filed a new version of his lawsuit alleging the image is child pornography.

The defendants named include surviving Nirvana members Dave Grohl and Krist Novoselic and the estate of Kurt Cobain.

A motion to dismiss filed in December by Nirvana’s attorneys argues that the suit was filed well past the 10-year statute of limitations of one of the laws used as a cause of action, and that another law it cites wasn’t enacted until 2003 and was not retroactive.“Elden has spent three decades profiting from his celebrity as the self-anointed ‘Nirvana Baby,‘” the document says.

The Associated Press does not typically name people who say they have been victims of sexual abuse, but may when they have repeatedly come forward publicly, as Elden has.

Lawsuit Against Netflix Over ‘13 Reasons Why’ Suicide Scene DismissedA federal judge dismissed a lawsuit against Netflix that was brought by the family of a teenager whose suicide was allegedly triggered by watching '13 Reasons Why' people always want money when somebody dies. Maybe you should look at how you raised that child? Cause im pretty sure millions watched it & did NOT commit suicide. Your child did for many reasons. TV shows can not avoid controversial issues cause of sensitivities amongst viewers I blame suicide on bullies, but could showrunners or something really be at fault for this in the same way? We do have to talk about it, deaths like this happen, and I want to learn how to help prevent them. So we should learn the right way to talk about it. It may not have been illegal to show this, but it definitely was wrong.
