“I recently learned the United Autoworker s union has taken the liberty of featuring my comments in advertisements released as part of its campaign to organize workers at Mercedes -Benz U.S. International, Inc. . Not only were these comments taken entirely out of context, they were also being used without my knowledge or permission. I do not personally endorse the UAW or its campaign and have asked the UAW to remove any advertisements featuring me from circulation.
Criminal defense attorney Roger Appell said ads like this, which used public comments from Nick Saban, fall into a legal gray area. He explains while political ads, such as those for a presidential campaign, using statements from their opponents are generally fine to use, if a company uses a pop star’s hit song in an ad for commercial benefits, they’d likely be sued.Appell says though there’s not much of a benefit for the UAW workers, the statements could potentially degrade Saban’s business relationship with other companies since unions are so divisive in our state.
“The splicing and taking parts of one statement and putting it into another statement is what really is the problem in this situation because I think if Saban had come on and said ‘I support the UAW and I believe that they should have an election’ and then they used it without his permission, I don’t think that’d be a problem at all,” said Appell.Appell says the removal of the ads was the right approach and since they’re no longer running, he doesn’t expect any litigation to come as a result.
