Defense attorneys for former national security adviser Michael Flynn released more documents Friday that they say show their client is the victim of prosecutorial misconduct and that the government suppressed clear evidence of his innocence.
While the defense submission is breathless in tone, the records largely add additional texture and support to previously known facts about the FBI’s probe into the possibility that Flynn was compromised by Russia. And the assertions of Flynn’s defense team seize on some of the documents’ ambiguity to support their version of events.include notes of a Jan.
Defense attorneys concede that just before Flynn pleaded guilty in the case in December 2017, prosecutor Brandon Van Grack told Flynn’s then-lawyers that the FBI agents didn’t sense deliberate deception on Flynn’s part during the pivotal January 24 interview at the White House. The documents do provide another window into the sometimes tense deliberations of the most senior officials in the Justice Department in the early months of the Trump administration, including acting attorney general Dana Boente, who took over the department after Trump fired acting attorney general Sally Yates after she refused to defend his travel ban executive order.
Some legal experts have said the government’s obligations to turn over potentially useful evidence to the defense are not as sweeping as the defense has suggested. For instance, the defense may not be entitled to all relevant documents as long as they’re told of the gist of what’s in them. And it’s unclear whether the views of prosecutors on potential weaknesses of the case would be considered exculpatory, as opposed to the observations of the agents who actually interviewed Flynn.
