According to the records, the effort was ultimately unsuccessful, and the federal agency opted against contracting with Microsoft, citing criticism the FBI had received over its use of the technology. Microsoft and the DEA did not respond to requests for comment.
The revelations by the ACLU come after Amazon and Microsoft announced last week they would not sell facial recognition technology to police departments amid nationwide protests over the death of George Floyd that called for an end to police brutality. IBM said it would end its facial recognition program altogether. But neither Microsoft nor Amazon said whether those measures extended to not selling to federal agencies.
“It’s very troubling, especially the situation we are in right now in the United States,” says Kade Crockford, a director of ACLU Massachusetts. “There is no federal regulation or law determining how government agencies can use these technologies.” Facial recognition has long proven a flashpoint for privacy advocates who say the technology violates privacy rights. In particular, police use of the technology has been increasingly scrutinized following reports that it disproportionately misidentifies people of color at a higher rate than white people.
