Ex-Lake Travis ISD student with severe peanut allergy sues district for $1.5M, alleging disability-based bullying & failure to protect him.

A former Lake Travis ISD student with a severe peanut allergy filed a $1.5 million federal lawsuit against the district, alleging persistent disability-based bullying .

A former Lake Travis ISD student filed a federal lawsuit against the district and several administrators, alleging he was subjected to persistent disability-based bullying and assaultsThe student, who filed the suit through his mother Shawna, claims school officials were deliberately indifferent to the ongoing harassment, failing to intervene, provide accommodations, or enforce disciplinary measures as required by law.

According to the complaint, in October 2023, the student disclosed to teammates on the school's football team that exposure to peanuts could be fatal for him due to his severe allergy. Soon after, two students allegedly emptied a can of peanuts into his athletic locker and uniform, triggering an allergic reaction. One student also threw peanuts directly at him.

The ongoing harassment and school's alleged failure to protect the student ultimately led him to transfer to another district in March 2024. The suit accuses LTISD of violating the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, and the student's constitutional rights. The lawsuit seeks $1.5 million in damages and injunctive relief to modify LTISD's policies and training on disability-based discrimination.
