- Justice Clarence Thomas on Monday urged the U.S. Supreme Court to feel less bound to upholding precedent, advancing a view that if adopted by enough of his fellow justices could result in more past decisions being overruled, perhaps including the landmark 1973 Roe v. Wade decision that legalized abortion nationwide.
Thomas said the nine justices should not uphold precedents that are “demonstrably erroneous,” regardless of whether other factors supported letting them stand. Thomas, 70, joined the court in 1991 as an appointee of Republican President George H.W. Bush. Thomas is its longest-serving current justice. He demonstrated his willingness to abandon precedent in February when he wrote that the court should reconsider its landmark 1964 New York Times v. Sullivan ruling that made it harder for public officials to win libel lawsuits.
In 2000, conservative then-Chief Justice William Rehnquist left intact the landmark 1966 Miranda v. Arizona ruling, which required police to advise people in custody of their rights, including the rights to remain silent and have a lawyer. Stare decisis has also split the current court, including last month when in a 5-4 decision written by Thomas the justices overruled a 1979 precedent that had allowed states to be sued by private parties in courts of other states.
“In our constitutional structure, our rule of upholding the law’s original meaning is reason enough to correct course,” Thomas wrote.
Impeach him!
And one of those precedents should be Supreme Court Justice for life and the first to be spun out should be him
They have stolen the courts!
Brown vs board of education Loving vs. Virginia Heart of Atlanta hotel v. U.S.
Riddle me this; When is a law no longer a law?
let’s reverse lifetime appointments...this ahole goes first, followed by the other abuser.
Jackass
Dred Scott v Sanford was a precedent. Plessy v Ferguson was a precedent. Should they have been overturned?
That's the opposite of conservative jurisprudence. They call themselves conservative, but they don't want to conserve any SCOTUS decisions of the past 80 years. Instead they want the groupthink of the Federalist Society to be law.
Thank you, Joe Biden! For this 'gift' that keeps on giving! (not)
Not this court’s job . That’s for Congress to initiate if the public votes for change on specific laws already on the book. A illegitimate president helped by a foreign country who then appoints two conservatives to the court which asks if they need removed .
USSupremeCourt Clarence Thomas partisan hack...he should be removed....Thomas and Kavanaugh have tainted the Supreme Court, and made it a danger to women and all minorities....remove the maggots and make the court all of Americas again...
Remember when he sexually harassed his staff and then had a court hearing about it?
That's what I said if they superceed it how does that make them look to me a little incompedent or shall I say negelgent and remember you have the ace space judicial king come up right behind you hows dream I sure is to sit where u 9 are
Good. Do it and throw the maggot out...along with Kavanaugh....two of a kind
Citizen’s United first!
Are we a nation of laws or a nation of precedents?
Roe v Wade
Does he even speak
Love this dude
Sounds like an activistjudge to me.
Of course he does.
That's not conservatism. It shouldn't be 'feel free.' it should be do with anguish and super-majority.
He will go down in history as one of the most destructive forces the supreme court has even seen. The definition of a right wing hack.
Why did I think this was an OnionPolitics piece at first glance?
In his defense he’s been saying this for 30 years. It’s only now that there’s a danger people might listen to him. Oh and he’s not talking about citizens United or anything. He’s talking about decisions recognizing civil rights for individuals not corporations
Like, sexual misconduct being OK.
We should feel free to impeach Thomas for being worse than Uncle Tom and inimical to our future.
The accidental jurist speaks. Nothing but an empty robe. The most intellectually lax SC justice of the last century. Has barely asked a question of any party during oral arguments in his nearly 30 years on the bench.
This is the problem with allowing abusers like Thomas and Kavanaugh on the Supreme Court, where they can make decisions that effect the same people they’ve already victimized.
He won't be happy until they start refusing him service at hotels and restaurants.
Really!
He got away with sexual harassment now he has an opinion on women's right? White Christian Women may let the GOP treat them like 🐑 and 🐄 but I doubt majority of Americans women will lay down and take it. So bring it on.
We could start by not sitting sexual assault offenders on the Supreme Court. Let’s reverse that precedent.
I wish bad things upon this man.
He's been urging that for 30 years, its just now looking like the Court might listen. Oh, and by precedent he means liberal decisions. He's not talking about Citizens United here, he's talking about all the Warren Court decisions that cons believe ruined the U.S.
This only seems dumb to me because of the state of the country.
That would render the Court, moot.
He has no business being on the Supreme Court! He hates his own people because of what Anita Hill accused him of!
Can the Supreme Court be bought via acceptance into the court or can they be bought with money? I had a high regard for the Supreme Court but now I question it's bias and opportunistic ways. The SC always spoke as a group and not as an individual politician.
How about the Senate reversing a couple of confirmations. Impeachclarencethomas
Day 1 in Law School: The importance of stare decisis coupled with an evolutionary need for the law to keep up with the reality of life as it changes. Evolution. NOT 'de-evolution.' Clarence is married to a white woman ... should that be changed backwards, too?
But Mitch McConnell literally stole a seat from the dems and Putin stole the 2016 election which led to another seat stolen from the dems. So yeah sounds like the perfect time to rip apart precedents.
Is he really a lawyer?
Mr Thomas is not just talking about precedents. His rhetoric is the yellow brick road to dismantle the legal system in the U S. The laws of precedents protect the poor. Non Precedent law is law for the wealthy
Don't forget people, SCOTUS justices can be impeached, just like a POTUS.
This guy has spent almost 30 years hardly saying anything on the bench, he should have stuck to precedent.
Justice Thomas, feel free to retire!
And you shouldn't be a judge either. But their you are. Hurting more people with your rulings than not. So sick of uncle Tom's and conservatives angry women.
Oh dear lord.
Nothing is safe. No one is safe.
He's aching to reverse Roe, Penn v. Casey and Griswold v. Conn. And a whole litany of civil/voting rights cases. It's all ideologically based, and has nothing to do with the law or the Constitution.
Thomas can you explain why you feel that way? I thought the Supreme Court kept America on an even keel & now you suggest confusing the American people on what you believe the Constitution original said? The SC makes a reversal & you believe all the other decisions were wrong?
Ya, so if he such a 'honorable; person wants to reverse precedents....start with the second amendment.....AMENDMENT being the key point. But no this is now about old men trying to dictating religious zealots agenda under a ignorant trump 'presidency'.
When Fascism rules the Supreme Court. Americans should be scared of this!
TERM LIMITS FOR EVERY OFFICAL in GOVERNMENT! THIS IS WHY NOTHING CHANGES! SAME OLD CRUSTY PEOPLE!
Please put the dope who wrote this headline back on the t swift beat thanks
Let's start by reversing the precedent that sexual abusers get to be Supreme Court Justices.
Does he know what a precedent is?
Let’s reverse the Anita Hill sexual harassment case, let’s start there!
Such as overturning Dred Scott? 😂
Cc SenatorCollins
Go Judge!
Says the activist judge.....
Shocked. SHOCKED, I tell you.
How does he feel about pubic hair though?
