) - A jury on Friday delivered a split verdict in the traffic death of a woman who was on a shopping errand 3½ years ago.
The jury rendered its verdict after a week of testimony in Mobile County Circuit Court. Prosecutors and Washam’s lawyers agreed that that the 25-year-old woman’s death was a horrible tragedy. But they disagreed over whether Washam, 39, was criminally responsible. But defense lawyers John White and Russell Bergstrom argued that Washam was under duress, pursued by gunmen who had just fired into his home. One of those gunman since has died from an unrelated shooting, according to the defense.
“We had a unique defense, duress, that he was under duress; he was being chased by two cars that were shooting at him,” he said. “That is a horrible situation to be in. I think he acted responsibly and reasonably. I mean, what’s the rulebook on something like that?”“He was trying to save his own life, and that’s job one,” he said. “And it was a horrible event that happened, and I think because there was a death, the jury needed to come to some sort of conclusion to support that.
