"The Court notes that Mo’Nique raises a novel theory here, namely that an employer’s failure to negotiate an 'opening offer' in good faith, consistent with its alleged customary practice which typically leads to increased compensation, constitutes an 'adverse employment action' for purposes of a retaliation claim," states the decision.

I'm glad to hear this....I hate how Mo'Nique was done wrong for speaking out and for being generally outspoken about the hypocrisies on the entertainment industry.
Mo’nique does have a point about Amy Shumer. Schumer’s last Netflix special was terrible, not funny at all and it has literally a one star rating on Netflix and scathing comments. Which I see they’ve removed 😂For Mo’nique to get millions less than Amy seems questionable at best.

Negotiating in good faith goes both ways. From the claim, it sounds like she publicly called the initial offer discriminatory which is hardly a good faith tactic. Had she privately countered & they still wouldn’t budge, then slam them publicly.
And one of the most frivolous ongoing lawsuits in the business is back for another round! I’m holding out hope that Netflix doesn’t settle just to make this extortion attempt disappear.
