In making the announcement Tuesday, U.S. Rep. Joaquin Castro said the couple doggedly battled both the state and federal governments to gain recognition of the dangers burn pits posed to American troops.“Through Rosie and Le Roy, millions of veterans impacted by burn pits have the health care they deserve, and veterans have recourse against state government discrimination,” Castro wrote in the nomination letter to President Joe Biden.
Le Roy Torres sued under the Uniformed Services Employment and Reemployment Rights Act of 1994. Congress had passed the law, called USERRA, to protect troops from being fired or losing benefits — such as vacation time — when they miss work for training exercises and deployments. It states that “by ratifying the Constitution, the states agreed their sovereignty would yield to the national power to raise and support the armed forces. Congress may exercise this power to authorize private damages suits against nonconsenting States, as in USERRA.”
“This is a humbling thing, you know,” said Rosie Torres, a San Antonio native living in Robstown. “It was never for a pat on the back. This was all just because we felt like, ‘Damn, if we’re going through this horrific journey, there’s thousands of others,’ so I don’t know. It hasn’t sunk in like, really, that here we are with this second recommendation. But it feels great to know we’re paving the way for other advocates.
