Numerous court cases and regulatory shifts later, they fall under the Food and Drug Administration’s purview and are considered a tobacco product.Depending on when they became available for sale, devices generally fit into one of three regulatory buckets. Anything marketed before Feb. 15, 2007, is exempt from regulation.
