There are just far more bright, talented young students in this country who ‘deserve’ to go to Harvard than there are spots at Harvard.

By ‘imperfect,’ I mean that SFFA did have a fair point, that Asian-American students were getting lower ‘personal ratings’ compared to white students with high ‘academic’ and ‘extracurricular’ ratings. Harvard gives all applicants four ratings on a scale from 1 to 6: an academic rating, an extracurricular rating, an athletic rating, and a ‘personal rating’ . Students that received a 1 or 2 in more than one area are more likely to be admitted. Let’s compare the percentages of Asian vs.

But by there being no fair alternative, I mean two things. The first is the judge’s finding, that “No Adequate, Workable, and Sufficient Fully Race-Neutral Alternatives Are Available.” None of the supposedly ‘race-neutral’ alternatives that SFFA proposed would actually be race-neutral.

You can’t admit the best student from each high school across the country because, again, it wouldn’t paint the whole picture, but also because there are about 37,000 high schools in the country and Harvard only admits about 2,000 students per year.
