Elijah Loveless Gray, 31, is charged with two counts of Level 1 felony child molesting . Each Level 1 felony count carries a 20-40 year penalty. Diane Chatme, 33, is charged with neglect of a dependent resulting in serious bodily injury, a Level 3 felony, and neglect of a dependent resulting in bodily injury, a Level 5 felony. Chatme, the girl’s mother, took her on Oct. 14 to a Chicago hospital thinking she was having seizures.
Chatme refused to take her to a hospital until Gray got home from work at 6 a.m., according to an affidavit. By phone, Gray said they could take the girl to a hospital only if they stuck to “the script” and took her to a Chicago hospital, assuming they would “accept it more” that the girl was so young and pregnant. Even after the Indiana Department of Child Services placed the girl earlier with another relative, Gray and Chatme violated a “safety plan” and saw the kids every day.
