BREAKING An appeals court has ordered a new review of the controversial DACA program for immigrants, which the Biden administration is trying to defend from legal challenges

The 5th U.S. Circuit Court of Appeals said a federal district judge in Texas should take another look at the program following the revisions adopted in August. The ruling, for now, leaves the future of the Deferred Action for Childhood Arrivals up in the air.

Texas-based U.S. District Judge Andrew Hanen last year declared DACA illegal. He found that the program had not been subjected to public notice and comment periods required under the federal Administrative Procedures Act. But he left the program temporarily intact for those already benefiting from it, pending the appeal.

The new rule's 453 pages are largely technical and represent little substantive change from the 2012 memo that created DACA, but it was subject to public comments as part of a formal rule-making process intended to improve its chances of surviving legal muster. DACA is widely expected to go to the Supreme Court for a third time. In 2016, the Supreme Court deadlocked 4-4 over an expanded DACA and a version of the program for parents of DACA recipients, keeping in place a lower court decision for the benefits to be blocked. In 2020, the high court ruled 5-4 that the Trump administration improperly ended DACA by failing to follow federal procedures, allowing it to stay in place.

It's was and end around amnesty E.O. by Obama. Not any law. Let's compromise. A DACA dreamer gets a pass if the parents are deported in exchange. After all they knowingly flaunted the law when coming here illegally.

Daca are grandparents now.. no one cares about them anymore.

that is when you know it is election season. Democrats only use DACA to play with people's emotions.

End it and deport

'controversial' DACA program? Really? Americans broadly support legal protection for DREAMERS by a wide margin: 74% in favor. What's controversial is GOP efforts subvert and dismantle any programs designed to help DREAMERS

Because it’s illegal.

Another court mulls Biden vaccine mandate for US contractorsNEW ORLEANS (AP) — A federal appeals court in New Orleans on Monday became the latest to hear arguments on whether President Joe Biden overstepped his authority with an order that federal contractors require that their employees be vaccinated against COVID-19. Please tell me these judges weren’t appointed by Donald “I know more than the virologists” Trump. Yes he did and no nothing will come back to hurt him. Keep filing lawsuits, lawyers get rich and people get screwed. Remember how ALL of America came together for polio?
