The family of a maintenance worker at a Grand Prairie apartment complex who was shot and killed while checking for burst water lines on Christmas Eve has sued...

The lawsuit faults the complex’s management company, The ValCap Group, LLC., for failing to “adequately inform” residents that maintenance workers would be doing spot checks for frozen pipes.

The lawsuit was filed Jan. 17 on behalf of the family of Cesar Montelongo Sr. Amid a winter freeze that blanketed North Texas, Montelongo was checking for burst pipes at the Clayton Pointe complex on Alouette Drive. He was on the balcony of a resident who apparently mistook Montelongo for a burglar and opened fire.Montelongo, 53, died at the hospital. The shooter has not been charged with a crime while authorities examine his claims to self defense.
