Facing imminent execution, James Byrd Jr’s racist killer petitions Supreme Court in last hope

Texas will execute white supremacist John William King for his role in the infamous killing of James Byrd Jr., on Wednesday evening—unless his lawyer's last-minute petition to the U.S. Supreme Court succeeds.

The Texas Court of Criminal Appeals on Monday voted 5-4 against granting King a stay of execution. His attorney, Richard Ellis, petitioned the U.S. Supreme Court on Tuesday to grant a stay of execution. Supreme Court justices held in McCoy v. Louisiana that the Sixth Amendment"guarantees a defendant the right to choose the objective of his defense and to insist that his counsel refrains from admitting guilt, even when counsel’s experienced-based view is that confessing guilt offers the defendant the best chance to avoid the death penalty.

Clara Taylor, Byrd Jr.’s sister, previously told Newsweekof her family's frustration with the length of time it has taken to execute King, and their fears of a new trial. “I feel like he had a right to appeal as much as the system allows him to,” Taylor said.

Texas will execute man tied to one of the most gruesome modern hate crimesJohn William King and two others beat James Byrd Jr., then dragged him behind a truck, tearing him apart. Prosecutors say it because Byrd was black. Don’t give John William King the luxury of an execution with my tax dollars, instead chain him to the back of a pick up truck and drag him across town. Appropriate sentence. Good.

James Byrd’s murderer will soon be executed. Will it bring closure after his horrific hate crime? The dragging death of James Byrd Jr. is one of the most notorious hate crimes in recent history. It’s a small band-aid on what is still a seething, seeping, septic wound of racial tension and disparity - but it’s something. I'd prefer he rotted in jail with no human contact of any kind until he died of Vitamin D deficiency, covered in sores. Alone. No visitors. Rotting. Why did it take so long?
