Lawyers for the defendants argued Thursday that the plaintiffs should be disqualified from the case because they signed contracts calling for leftover embryos to be destroyed. That is akin to abandonment, the defense argues in a court filing. The defense argues that Mobile County Circuit Judge Jill Phillips should appoint a lawyer, known as a guardian ad litem, to represent the interests of each of the embryos destroyed when someone took them out of a freezer at Mobile Infirmary and dropped them on the floor.
