In his response to Jeff's suit, David claims Wittek knew how risky the stunt was and can't blame David for his injuries. David is asking the judge to dismiss the complaint and award nothing to Jeff.

This is what happens when you do anything for views. Jeff is a 32 year old man who made a decision to hop on a crane controlled by a 26 year old man with no excavator training. Both lacked common sense and both are to blame 50/50, no one intentionally set out to harm the other.
Anyone who has been to Dennis the Menace Park in Monterey CA before 1998 knows the helicopter ride & has seen at least 2 dozen kids almost die from just this sort of thing.
