In the petition sent to the Northern District of Texas, Michael J. Lang, attorney for Highland Capital, said Jernigan has “ignored undisputed testimony and evidence, questioned the motives of Mr. Dondero, accused Mr. Dondero and the other Petitioners “bad faith”; and reached conclusions hostile to Mr. Dondero without evidence or contrary to uncontested evidence.”
According to the petition, Jernigan claims that she had never heard of Highland Capital’s former name. In the petition, Dondero claimed that Jurnegen had also referred to him as a “vexatious litigant” on numerous occasions.“I have commented before that we seem to have vexatious litigation behavior with regard to Mr. Dondero and his many controlled entities,” Jurnegen said, according to the petition.“Judge Jernigan’s bias has had a chilling effect on Petitioners and their counsel.
