Gadberry Construction and owner Dustin Gadberry filed the lawsuit in Dallas County District Court this week.

He believes the City Council should have awarded his company the right to construct the Hi-Line Connector trail near the Design District because its bid was $775,000 less than the firm that got the deal on April 23.

Dallas County Judge Kristina Williams on Wednesday blocked the city from formally giving the contract to Fain Group and told the city not to allow any work to be done related to the project, court records show. She ordered a May 25 hearing to allow representatives from the city to explain why she shouldn’t grant Gadberry’s request for a temporary injunction.

In a response to Gadberry’s request for a temporary restraining order to halt the awarding of the contract, the city stood by its decision. “We award to the lowest responsible bidder, it’s not necessarily the low-cost bidder,” Opoku-Acheampong said. “If we review and you’re not qualified, just because your bid is low, you don’t get the award.”
