A California man says the North Carolina hot sauce company is misleading customers.

describes the brand’s origins and why it’s made in North Carolina. When trying to think of a name, company founder Sam Garner chose Texas because it “had a reputation for spicy cuisine,” according to the website. Pete is a nod to his son’s nickname.

The website also says: “The current factory, built in 1942 and added onto too many times to count, sits on the original Garner family home site in northwest Winston-Salem. And legendary Texas Pete, proud of his cowboy heritage but also a proud North Carolinian, continues to thrive.” While Texas Pete’s label on the back does say it is manufactured in North Carolina, the lawsuit says it’s likely not enough for the customer to notice.

That’s because Texas Pete’s label uses “distinctly Texan” imagery, including “the famed white Lone Star from the Texas flag together with a lassoing cowboy,” the lawsuit says. The cowboy is also etched into the glass on the front of the bottle. Regardless of the label, there is “surprisingly nothing Texas” about Texas Pete, according to the lawsuit. It isn’t even made with ingredients sourced within the state of Texas.
