A federal appeals court said California can continue to enforce its longtime ban on rifles labeled assault weapons while the state seeks to overturn a lower-court judge’s ruling that declared the gun law unconstitutional.
A three-judge panel of the Ninth U.S. Circuit Court of Appeals late Monday granted a stay requested by California Attorney General Rob Bonta, who is appealing U.S. District Judge Roger Benitez’s June 4, which was first enacted in 1989. The current version of the law criminalizes possession of certain semi-automatic rifles, including AR-15-style guns, with detachable magazines and certain features such as a pistol grip.
“This leaves our assault weapons laws in effect while appellate proceedings continue,” Mr. Bonta said in a tweet. “We won’t stop defending these life-saving laws.”
