Two hearings are set for Thursday after Kohberger and his attorneys filed a motion to dismiss the indictment, citing a biased grand jury and lack of evidence.MOSCOW, Idaho — Bryan Kohberger, who is accused of murdering four University of Idaho students last November, will be back in court this week for two hearings to dismiss his grand jury indictment.
The hearings were originally scheduled for last month but were pushed back to Thursday, Oct. 26. The first hearing at 9:30 a.m. is sealed and will be closed to the public. The second hearing at 1 p.m. will be open to the public. Both will address the motion filed by Kohberger and his attorneys to dismiss his grand jury indictment that occurred in May.
For the second hearing that will be open to the public, the grounds for dismissing the indictment include"error in grand jury instructions." Because of this, the defense either wants the indictment thrown out or wants a preliminary hearing held in its place.arrested at his family's home in Pennsylvania, which led the judge to enter five not-guilty pleas on his behalf, which included four counts of first-degree murder and one count of burglary. The state alsoagainst Kohberger in June, with the prosecuting attorney citing his "utter disregard for human life" and a"continuing threat to society.
