The executive order would reportedly allow the Biden administration to deport those migrants to Mexico or their home countries. The order will purportedly mimic the bill that failed in the Senate last month, which would have allowed Biden to temporarily shut down the southern border if daily crossings exceeded 4,000. The ban stems from Section 212 of the Immigration and Nationality Act, which allows the president to pause the entry of all migrants for as long as he sees fit if they are “detrimental” to the U.S.
Congressional Republicans do not care about securing the border or fixing America’s broken immigration system. If they did, they would have voted for the toughest border enforcement in history,” the president said following the bill’s failure. “Instead, today, they put partisan politics ahead of our country’s national security.”
