Not only has the 5th Circuit ruled unfavorably toward the Biden administration’s position previously in a related case, but any decision is also likely to be appealed to the Supreme Court, where the conservative majority would be expected to rule against DACA.
Sen. Kyrsten Sinema, D-Ariz., who has often gone against her party on key legislative proposals, said she would like to focus on immigration reform after November’s elections.

If Democrats pick up seats in the Senate, they really have no choice but to reform the Supreme Court with term limits and additional justices. Trump’s appointees lied under oath and Thomas probably participated in his wife’s coup.
