Attorneys deliver closing arguments in trial for 2022 UA campus killing

TUCSON, Ariz. — It’s now up to a jury whether the man who shot and killed University of Arizona Professor Thomas Meixner should go to prison or be confined to a psychiatric hospital.

Dervish’s defense concedes he shot and killed Thomas Meixner but claims he should be found guilty except insane because he did not understand his actions were wrong. In closing arguments to the jury, Prosecutor Mark Hotchkiss said Dervish showed plenty of preplanning that fits premeditated first degree murder, and showed he knew killing Meixner was wrong, through statements ahead of the killing, statements to police and through his attempt to get away.

Though Prosecutors called mental health experts who said they did feel Dervish understood the shooting was wrong, defense attorney Leo Masursky cited different mental health witnesses who said Dervish had prior mental health commitments, and his performance on assessment tests convinced them that at the moment when Dervish was in the act of shooting Meixner, he did not know the act was wrong.
