WEAR reported Wednesday that the Fortson family hired Crump as their attorney in this case. Crump alleges deputies responded to the wrong apartment during the fatal shooting. "The circumstances surrounding Roger's death are both distressing and in need of urgent investigation," Levin Papantonio Rafferty said in a release. "Heartbreakingly, Roger's last words, 'I can't breathe,' echo a chilling familiarity with similar cases of injustice and police brutality that have plagued our nation."
The Okaloosa County Sheriff's Office said a deputy acted in self-defense that afternoon after hearing sounds of a disturbance inside Fortson's apartment. The Florida Department of Law Enforcement is investigating the case, as is the State Attorney's Office.
