A downstate judge is expected to rule Friday on a temporary restraining order for the IL assault weapon ban passed earlier this month.

A downstate judge is expected to rule Friday on whether to grant a temporary restraining order to put a "pause" on a new law that bans many assault weapons in Illinois.Since then, it's faced push-back from gun owners and even some area sheriffs. An emergency hearing was held Wednesday to try to stop the new Illinois assault weapons law from being enforced.

The suit was filed by Tom DeVore, last year's Republican nominee for Illinois attorney general, on behalf of hundreds of plaintiffs."The Illinois legislature wants to pass a law that restricts gun rights? Then they need to pass it procedural appropriate," DeVore said."Whether a restriction is good, bad, illegal or not, or violates the Second Amendment, those are for the federal court.

The suits name a number of defendants, including Gov. JB Pritzker and Illinois State Police Director Brendan Kelly. It calls the law unconstitutional, saying this assault weapons law was adopted for "self serving political purposes."

You can not infringe on our rights. They put a phrase from the US constitution in scare quotes. But a totally partisan, bogus term like 'assault weapon' gets no such treatment. Good. They will prevail!

Legal battles mount against Illinois' assault weapons banSince Jan. 10, when Gov. J.B. Pritzker signed the 'Protect Illinois Communities Act' legislation — which bans the sale and distribution of assault weapons in Illinois — the new law has been hit with a barrage of legal claims. It has been hit with legal claims because it obviously fails the standard set forth in NYSRPA v Bruen. I can't imagine why they even tried to do this in the first place when it was obvious it would be overturned. Ño
