The Arizona Supreme Court ruled Tuesday to reinstate a 160-year-old abortion ban, decimating abortion access in the state and adding fire to several competitive House races this fall.
The decision follows a ruling from the Florida Supreme Court last week allowing a six-week abortion ban to take effect there, bringing the number of states with near-total abortion bans to 16.“This reckless decision from the Arizona Supreme Court will put people in life-threatening situations and force many to flee the state for the care that they need,” said Athena Salman, director of Arizona campaigns for Reproductive Freedom for All, in a statement.
U.S. Rep. Ruben Gallego, who is running against Republican Kari Lake for a Senate seat in November, called the decision “devastating” and used the opportunity to note that his opponent previously called the 1864 ban a “great law.” “The territorial law is archaic,” said the Republican, who also expressed his support for the 15-week ban. “We must do better and I call on our state policymakers to immediately address this in a bipartisan manner.”
