A state court has denied the appeal of a Tyler man accused of killing a Trinity University student in 2017, paving the way for his retrial. Mark P. Howerton’s first murder trial ended with the jury deadlocked.

Howerton has maintained his innocence. At trial, his attorney, John Hunter, alleged that Mandadi agreed to go to Houston with Howerton after the festival, and that they stopped at a gas station and had rough make-up sex. Testimony in his trial established that, at some point, Mandadi stopped breathing, so Howerton drove her to a hospital in Luling. She was covered in bruises and was not wearing pants when they arrived at the hospital. She later died and Howerton was charged with murder, sexual assault and kidnapping.
