The Brexit circus moved to a new ring this week. The Supreme Court got some rave reviews while others argued that it is a constitutional outrage that unelected judges should be second-guessing the actions of the government and prime minister.
All the people taking legal action against the government are known opponents of leaving the European Union, including businesswoman Gina Miller, who won a previous anti-Brexit case in the Supreme Court, and the MPs supporting the Scottish case.
The justices on the UK Supreme Court have no problem with this. They do not have the power to overturn primary legislation, that is laws passed by a majority of MPs. But they can overturn secondary legislation - administrative measures taken by the government - and under the European Convention of Human Rights they can issue a highly influential but non-binding"declaration of incompatibility" about laws.
