The actor is due to appear in court later this month to face charges relating to the death of cinematographer Halyna Hutchins on the set of the movie Rust.

Alec Baldwin is attempting to have one of the charges of involuntary manslaughter, which could see him jailed for five years, thrown out by a US court.

was charged with two counts of involuntary manslaughter by the Santa Fe District Attorney's office, over the death of cinematographer Halyna Hutchins in on the set of the western movie Rust in October 2021. The second charge is involuntary manslaughter in the commission of a lawful act, which requires proof that there was more than simple negligence involved in a death, and includes a firearm enhancement, which makes the crime punishable by a mandatory five years in prison.

"The prosecutors in this case have committed an unconstitutional and elementary legal error by charging Mr Baldwin under a statute that did not exist on the date of the accident," the motion read.

Due to 'error' someone's dead that can't change..

This guy lied and not pulling the trigger first He needs to go to prison for manslaughter like anyone else would He's not above the law because he's famous. It's his fault he knows that and trying to get away with it due to legal errors lol Disgraceful behaviour.

There's something extremely dodgy about all this, how do you get a live round on set, kill someone, and no one goes to prison... It sets a precedence.. You could kill anyone.

Is it necessary to use a real firearm when making a film?

The Armourer, not the actor, has the responsibility for the safety of weapons used when filming.

Can't have people being held accountable for their actions can we. Especially when they're an actor don't you know.
