Judge Stephen Hellman said Chaim Adler was 'humiliating and intimidating'A father sued for storming into his high-flying neighbours' garden after they confiscated his son's football revealed tonight the legal row has been 'five years of hell' for his family.
The neighbours sued Adler over trespassing and harassment which saw a judge award £19,800 in damages. Giving judgment, Judge Stephen Hellman said fire alarm company boss Mr Adler had been provoked by the Bergsons' actions in not giving back the ball but he had gone too far. Trouble first brewed on the street in north London after Dr McAndrew-Bergson and her barrister husband moved in next door to the Adler'sShe added: 'We do not have any choice but to pay. We have had to have solicitors and they have had to be paid. This should never have come to court and the judge was wrong in what he said. They were not nice people.
The first clash took place in August 2017 when Dr McAndrew-Bergson was hanging out clothes and water suddenly began spilling into the garden from next door. The Bergsons said the trouble peaked in two confrontations with Chaim Adler, a frequent visitor to his parents' home, over a long weekend in May 2018.
Mr Bergson then decided to confiscate it, taking it into his flat on another occasion over the same weekend in order to get some peace. In what the judge called 'haunting' evidence, she said her husband had also been surrounded during the weekend, with Chaim Adler mocking him, shouting 'here here' and repeatedly kicking his right leg in the air.
He ruled that Chaim Adler had harassed the Bergsons and trespassed, when 'at least part of his body' entered their flat during one of the incidents.
