The National Crime Agency has secured the first Unexplained Wealth Order in Northern Ireland “against a man suspected of involvement in serious organised crime”.
The Armagh couple hae not been named. UWOs “require a person or entity suspected of involvement in, or associated with, serious criminality to explain the origin of assets that appear to be disproportionate to their known income”. They are obtained at civil courts and allow the NCA to “recover property which it can prove on a balance of probabilities has been acquired through unlawful conduct”. The orders can be obtained even if there has been no prosecution got any criminal offence.
“The Order followed a number of legal challenges in the High Court by the Defendant’s Senior Counsel, including an unsuccessful challenge to the legal standing of the NCA in Northern Ireland.”
