Coronavirus: England's test and trace programme 'breaks GDPR data law'

Privacy campaigners say England's test and trace programme has broken a key data protection law.

The Open Rights Group says the admission means the initiative has been unlawful since it began on 28 May.their name, date of birth and postcodenames and contact details of people they have recently been in close contact with, including sexual partners. ORG had threatened to go to court to force the government to conduct a data protection impact assessment -for projects that process personal data.

ORG's executive director, Jim Killock, said the government had been"reckless" in ignoring this legally-required safety step and had endangered public health.

Well DUR!!!!! what would you rather Data breach or catch the bloody virus?

Test and Trace programme 'breaks GDPR data law' Protecting our privacy is the biggest challenge of our generation. – we need tech with “privacy by design” like iotex_io to guarantee our privacy

Test and trace was crap the minute it came out , another case of big brother tracking your every move

The website that sells me t shirts can get that right

peanutbubin Well that's what happens when you let people with no experience do it because they are friends.

nistaleos 😱🤭

Shouldn't this be the work of an opposition party To hold the government to account and ensure that the slightly extended powers required to fight a virus have appropriate checks and balances. Any sign of labour at all? Becoming so disillusioned by them.

So I’m assuming the millions of pounds paid for this illegal, faulty programme will be returned due to a breach of contract? If you buy a toaster and it doesn’t work when you get home, you get your money back. Aah, friends of the Tories you say... ToryCorruption

It doesn't work anyway! It should be immediately halted & stopped until EVERYTHING IS FIT FOR PURPOSE & LEGAL! & the government should be sued!

OK? Isn't it voluntary?

No shit Sherlock

Have you met Dominic Cummings and seen what he does with our data? They could have designed the app without harvesting our data but they choose not to.

Not a dry bed in the house 🤣

CllrBSilvester Yet people don't believe the white hats are in control . you have to make the people want the Government to be taken down and that's what's happening . Why are they using doubles then , Hancock is under arrest .

JHinkley24 Talk Talk Test+Trace... A 10 million to one chance...

Piers_Corbyn Testing is useless, here is proof! WHO protocol on PCR testing, says in areas of widespread Covid-19, (where isn't it widespread? 🙄) , a positive indication of any betacoronavirus, is sufficient to be a positive test for Covid-19. Betacoronavirus's include the common cold!

Not surprised at all. That was its main purpose. Data surveillance.

Of course it does.

ALM... STOP shopping on line.. Only use hard cash... Get out of house and buy at shop with cash.. No more home delivery.. Just think.. No more delivery drivers No more air pollution by the drivers.. Data protection sorted 👍🤗🤗😇😇 ALM

Syoungjba Don't you find it odd that local health authority track n trace protocols that have existed for decades aren't being used? Of course that would require the disease to be diagnosed by a qualified health professional .. which isn't happening is it?

They also broke electoral law, that’s just what the Tories do, but get away with it.

So what? The BBC are totally discriminatory to honest hard working white people & need to be defunded, broken up & their woke, left wing hacks sacked

Another government shambles.

SenseiChanning If it helps, Ireland has a fully functioning T&T system that cost €850k to set up, ironically already adopted by Northern Ireland and Gibraltar.

Needs must.

You know what - I don’t care - I’d much sooner know so I can take care of my friends and family

Now that is a surprise

Bet there are a few frightened criminals and illegals out there that this might also trace. Why is it only the good people seem to die of the virus and not a load of the lowlifes that habit this country

So the Home Office wouldn't give Public Health Scotland access to data so that Scotland could do a contact/trace on people entering the country because they were concerned there would be data breaches so a Memo of Understanding was issued causing further delay. How embarrassing.

What are you playing at DHSCgovuk?

And you want to give us a Vaccine.... No thanks.

This was obvious

BBC breaks advertising laws... always advertising programmes and charging tv taxes for it

I hope they put out a statement saying 'your personal data protection is less important than our collective health' and then just leave it at that and refuse to talk about it again.

There is no evidence of data being used unlawfully. NHS Test and Trace is committed to the highest ethical and data governance standards. You can read the privacy statement here ⬇️

What a surprise.

So what.

One of the shittiest, infuriating EU laws. Sums them up

Not a surprise to those of us that were paying attention.

So some think data protection is more important than lives middle class rubbish BBC tell your bosses at Labour to get their act together.

Yay! Who do I sue?

Between that and death, not so bothered about the law

Bollocks typical labour run bbc shite

This on top of the NHS DEATH CERTIFICATE SCAM!!!!

mconway70 Here, I will make it easy for you and your public-shool-educated halfwit employees:

Who cares, if it helps to get rid of covid 19.

Time to wake up from this MASSIVE hoax. NoMasks Scamdemic ContactTracing CovidHoax

When data is more important than a pandemic.

TotallyConor Surely in a GlobalPandemic with millions of deaths something like GDPR is irrelevant to help save lives Global Emergency means we have to bypass somethings for the survival of people. CommonSense

It was the EU which brought in the over zealous of GDOR. UK had own DP rules which served quite sufficiently. But now it’s a mess.

No it doesn’t . The coronavirus legislation a changed the law to set aside GDPR. The EU also specified that GDPR doesn’t apply

Worse than useless. I hope people at least regret their vote

Emergency Covid Legislation, March 2020. Dispensed with due diligence. Cooking the books /data manipulation has been de facto practice behind the Covid Scam.

How many of you shred every letter with your details on or sign up for online services with your details, it's nothing new and you will keep on doing it.

You couldn't make this up what a Fu**ing disaster this govt is. Surely that would be on the top 10 things to account for when putting this project together.

Common sense and saving lives over GDPR any day

Who would have imagined such an outrage? NeverTrustATory

brawday I got Google tracking me but at least I agreed to it.

Lots of complaints about data privacy by people who willing give their details to Google, Apple, Twitter, FB etc without hesitation

With Cummings running the Government, anything is possible under this sleazy, Psycho wackjob.

So we trust Cummings not to sell this data on to one of his or his family's dodgy companies ...Cambridge Analytica, for example? Hancock is said to be a shareholder ....C'mon the people are not stupid!

Oh God, can this Governement get anything right, it's almost like we are being lead by Lemmings.

To be honest, I don’t think it matters in the middle of a pandemic. This is not the time to be worrying about your privacy, it’s all about ensuring our survival.

Is this another Tory shambles?

Who is behind the bbc . ? Trying everything in their power to get at the goverment . This is not normal .

3salmon If only they'd adopted the German system, which doesn't hold your data for 20 years.

It isn't breaking anything like as many laws as coronavirus! Sometimes a balance has to be struck. I love the BBC but you do like picking holes and pointing out the negatives!

There’s an exemption when it’s in the public interest such as a public health crisis. Also yes we may have left the EU but U.K. law has adopted GDPR for the foreseeable. Move on...

Test and trace is essential to restarting the economy and saving lives, a loss of privacy may be the price we have to pay.

Why is she holding a box of grapes and cherries?

That’s the least of our problems right now

Although I really don’t care, does it at least mean the Gvmnt will cancel the £180m fine on British_Airways last year for the criminal cyber attack on them which compromised GDPR data? BA also said there was no evidence data had been misused and they were victim of an attack!

Incredible oversight in setting this up. That said, there are bigger things to worry about. We do not want govt focus to move onto a gdpr breach when there are a lot bigger issues at stake. The responsible exec should be fired and then we move on.

Stick it on the long list of failures this Government is responsible for!

Didn’t carry out an assessment? Our parish council has a page on GDPR on their website but the company contracted to do TestandTrace didn’t consider privacy?

Government make the rules. So they can break the rules. The government only stand by MPC. Aka money, power, control. FACT

Lockdown breaks human rights laws but you have been quite on that. Time to end the bbc defundBBC

So what

I always thought that the 'I've had a positive test' message would have come better from the person rather than a faceless unknown. I don't share people's details anyway so would struggle to comply with this.

I see all the armchair pandemic experts are now also armchair legal experts 🙄

We’ve known that from day 1. It’s the only thing Cummings ever does, selling people’s data.

Wow, after all this time you’ve just worked that out? Well done BBC

the BBC are the enemy of the goverment - extraordinary DefundTheBBC

Best in the world

The problem that is a crime is the businesses that have been collecting details of customers for track and trace purposes but then putting those details onto their marketing lists - lots of barbers and hair salons have been called out already.

Question is will they store our dna ?

The greater good has to prevail and if the expense of some data is the price so be it.

Of course it does. And what will be done about our govt being caught acting illegally yet again? Nothing at all is my guess

Surprising. Dido Harding is normally so careful to protect people’s data🤔. Oh, wait...

What sad stain of humanity takes personal data technicalities over track and trace in the interest of the nation.

Does it. Really. Permission given. There is an interest. So does it. Really

Pathology Dr. John Lee. He has written such common-sense and yet exceptionally scientific articles on this seasonal viral challenge. The technical reality is nothing like that portrayed in the media - that's for sure.

The risk of privacy problem is potential but loss of lives during pandemic is real.

Oh phew, about time. I'd rather be exposed to the virus and die from it than someone know my phone number and where I was that day.

Great chunks of the Human rights convention have been broken too, but sometimes things have to be done to protect the greater good.

Do you actually want us to get through this pandemic......................

scotgov ScotGovFM nhsscotlannd procedure in Scotland in March didn’t operate this way. It complied with GDPR. And media and Opposition referred to case handling protecting privacy as a cover-up

No it doesn't.

Why can't you say the truth! Government run by the Conservatives, is breaking the law it introduced only 2 years ago. Using an outsourced dodgy company, at the heart of who we have Dido Harding! Who btw has been CEO of Talk Talk, when they had 'Data Breach' issues.🙃

Oh dear. What dilemma for the wokesters! To attack the govt because track and trace isn’t good enough or to attack them because it’s so effective it breaks GDPR - the new “elf ‘n’ safety” catch all for stopping everything. Yawn.

marcuschown Funny how EU countries have managed to do test and trace without breaching GDPR rules.

News, would be if they hadn't done this. Seems more like BBC making issues than anything else here....🙃

Absolute shambles. The idiots who voted in this clown government should feel embarrassment and shame. Because ultimately, they are responsible for this.

BuT wE aRe No LoNgEr iN tHE EU!! Morons.

Surprised at people's reaction.. If your elderly parents give their details to an non vetted source and lose their life savings you may not be so happy... Or you leave your details on that A4 sheet of paper at the hairdressers for others to see and use.. . No guidance provided

McCDick Not at all surprising 😠

marcuschown Almost as if the Vote Leave chancers in No10 we’re involved..🙄

Lockdown breaks the law. Working from home breaks mortgage/rental terms

I could not possibly care less about GDPR.

I dont fucking care if saves live ffs

No really...

Hmmm another misleading headline from the BBC wonder how many will take it verbatim and not read the article for the actual truth

Health & safety law supersedes all other laws If you want to go down this route millions of people working from home could have have potentially broken it too

Everybody whinging whilst they log into the kings of data theft, Facebook, Twitter with no hesitation.

BBC stands for Broadcasting Bloody Crap.

Oh ffs I think letting people die when they can help would take priority.

People need to read the detail in the Covid law, overrides so much - also GDPR is EU law (which we left)

is it functional and is it making a difference?

I don't think GDPR was intended to protect the ability of morons to spread lethal infectious diseases. Maybe that is just me though.

Smokescreen this. You’ve given consent and you know what the data is being used for. 🙄

Covid-19 has carved inroads in norms of strict compliance with the data protection law. The expectations to the collection, retaining, sharing and publicising of personal data are numerous.

It’s EU law, to protect people’s data. why so worried?

Make your fcuking minds up !!

While data protection has a vital role in keeping our online lives secure, some things are more important than doing a risk assessment to see how the data will be used - like trying to stop a pandemic. It's time there was a national return to using common sense

Plus the test is 0% accurate.. But hey who cares 😂

What about the text very single person in the UK received from the Conservatives back in March of this year?

Reminder of the numbers in U.K. Confirmed cases 294,792 Covid Deaths 45,300 That’s 15.2% or 1 death in every 6.5 confirmed. And some tin pot group threatens court action over data law breaches when Govt try and trace possible affected persons to save lives. Get bloody real folks.

It's clear that anything that the Johnson/Cummings crime syndicate put their hands on that has to do with data cannot be trusted. Their whole political success is based on corrupt data mining and mass manipulation strategy.

By saying its good

No shit.

RowleyfileRRR I have no words! Well, a few. You all give your personal data away for free to every app and free offer you sign up for. Where's the outrage over that? Sign up for T&T and help fight C-19.

CathyCathyFox 🚨 🚨 🚨

Cambridge Analystica...remember them?

GDPR biggest load of red tape and a huge EU control mechanism ever, they even want the USA to adopt it 🤣🤣🤣

Is your privacy really more important than your life?

I agree we all need privacy to some extent but GDPR is a detriment to the society at large. It only adds to the list of things that's promoting the culture of compensation in this country (like health and safety which has gone a bit too far in this country).

Well this is going great

Is there anything this government can get right? ToryShambles

Laws? Didn’t everyone willingly abandon them out of fear?

Another government bulls up.

GDPR is the reason I’m not allowed to take a photo of my daughter when she is performing a play at school. Such a load of nonsense

SO NOW THE MARXIST BBC IS TRYING TO SHUT DOWN THE TEST AND TRACE PROGRAMME. THIS IS 'DEFINITELY IN THE PUBLIC INTEREST!!

So why haven't the Open Rights Group gone after the governments of Scotland, Wales and Northern Ireland too? I smell lefties.

Who the F cares about GDPR in a pandemic? 🤦‍♂️

Don't care. If I've been in contact with someone with covid, I want to know Interesting (not surprising) that only England is being challenged about breaking the EU law. Do Scotland, Wales & NI not have to follow the same rules?🤔 It's almost as if this is politically motivated

For God's sake! 🙄 If you haven't figured out why people want to defundthebbc read the comments responding to your tweet. Let track and trace save lives. I despair

Sometimes saving lives means breaking beurocratic rules but the BBC go with it, they would also do this Here is the news from the BBC The UK gov has killed peopled by following GDPR rules DefundTheBBC

Why is BorisJohnson and his shower of incompetents finding it so hard to comply with the law of the land?

Shocker!

the Tory Government is totally incompetent .

Quite right too, we can't have people riding roughshod over EU law, how can we?

We are no longer part of this EU drivel.
