A businessman who hacked the branches off a tree that was blocking sunlight from his home was ordered to pay back the £21,000 it added to the value of his £1m property in the first case of its kind in Britain.

This can be easily appealed. An absolute abuse by Poole Council using POCA. POCA should only be used for significant criminal cases where it's in the public interest to set the offender back to square 1. This man is obviously not a criminal in the usual sense...

Had a tree that had a preservation order on it due to bats that nested & fed around it .. council still came around & cut it down ...

Proceeds of crime, no? He should pay a fine of 21k to the courts if he sells or whatever % 21k is of the overall value in rent he gets a month.
