Medical Chief II Rolando Cortez was accused of violating Section 3 of R.A. 3019 or the Anti-Graft and Corrupt Practices Act, alongside Finance Management Officer Marieta Cruz, Chief Administrative Officer Jose Calixtro, and Administrative Officer V Bonifacio Ramos.
From January 23 to February 23, 2006, Cortez, Cruz and Ramos were once again charged with graft for giving undue advantage to FRDE Sales and Services for the purchase of air conditioning units and exhaust fans worth P450,950. Cortez, Cruz, and Calixto filed a motion for leave of court to file demurrer to evidence, since they wanted to challenge the prosecution’s evidence as insufficient to render a guilty verdict. They insisted that the prosecution failed to prove all the elements of graft.
