In its ruling, the anti-graft court said that there was no substantial evidence of intent on Kampitan’s part to deceive the authorities and conceal his business interests. Although he offered no formal resignation, the anti-graft court noted that four witnesses corroborated each other that he indeed resigned and that his offer was accepted by the Board during an informal meeting.
Kampitan’s failure to disclose his business interests is not sufficient to find him guilty of the perjury charges, the court ruled.
