THE Office of the Ombudsman has found probable cause to file 41 counts of graft before the trial court against Mexico, Pampanga Mayor Teddy Tumang and four others in connection with the alleged irregular procurement of construction materials amounting to P8.66 million from March 2009 to February 2010.
“Although there is no direct evidence that public respondents appropriated the said funds, there is, nevertheless, sufficient proof to show that they were complicit in allowing private respondent Colis, through Buyu, to appropriate the same,” the resolution read. The Ombudsman said Tumang and his co-respondents “acted with manifest partiality, evident bad faith or gross inexcusable negligence, causing undue injury to the government” when it gave Buyu unwarranted benefits and advantage in the procurement project.
Graft investigators anchored their findings on a prior Commission on Audit report that showed shortcomings in the Mexico municipal government’s purchase of base coarse and other construction materials intended for distribution to residents in various barangays. The Ombudsman said the respondents broke the law and ignored established rules by approving the purchase of construction materials through an alternative “shopping” method, despite the clear absence of the conditions required by RA 9184, also known as the Government Procurement Reform Act, for the proper use of alternative procurement methods.
