The Bexar County Commissioner s Court has opted not to take a vote on a subdivision plan for a development involved in a controversial land swap — a step that could lead to financial penalties for the county. Commissioners this week were asked to give approval for a plat for a 106-home subdivision on the north side of San Antonio , just outside city limits.
Feds OK swap of property set aside for endangered birds Residents in the Cibolo Canyons area have been fighting the change, arguing that the land being added to the easement isn’t suitable for the warblers. They submitted an appeal to the agency, asking it to reconsider the decision; the service said in November that the appeal is being reviewed.
Comal County aims to expand habitat for endangered warblers But the county’s lawyer told commissioners that whether or not they voted to approve the plat, it would be approved anyway. Larry Roberson, chief of the Bexar County District Attorney’s Office civil division, said that once a plat application is deemed to be complete, with all legally required documents submitted, a 30-day clock starts.
Commissioner’s abstentions raise concerns over leadership Commissioner Grant Moody, whose precinct includes the development, asked if the opponents' pending appeal with the Fish and Wildlife Service would allow the court to delay a decision and table the application until January. “The appeal of the permit is a separate process,” Reinhardt said. He said he empathizes with the residents who addressed the court, but that the county’s jurisdiction over plats is limited.
