“Schools and education institutions should ensure all staff and the school community are sensitised on what is appropriate and inappropriate conduct.Sexual harassment is defined in the Bill as any unwanted conduct of a sexual nature directed at a person which is reasonably offensive or humiliating or is a threat to his or her well-being.As it is a civil system, the burden of proof is on the balance of probabilities.
It is also interesting to note that under Section 82 of the Penal Code, a child under the age of 10 cannot be considered to commit a crime. Youth activist Ain Husniza Saiful Nizam, 18, says many youths her age do not know what laws are relevant for their protection.
