: The High Court here today ordered that the fine against the offender of the air pollution in Pasir Gudang in 2019 increased to RM80,000 per charge compared to the RM40,000 per charge as initially meted out by a lower court here.
In the judgment, Abu Bakar said the court held that once P Tech Resources had been offered the eight optional charges for offences including air pollution, the prosecution could not rely on evidence during the trial relating to the original charge involving the dumping of sediment into the river to appeal for the maximum fine.
“The Sessions Court judge when sentencing the respondent was not influenced by the mass media’s coverage of the pollution of Sungai Kim Kim. “If the Department of Environment does not inspect the respondent’s factory premises, this offence will continue to occur and it will cause severe air pollution to the residents,“ he said.
Deputy public prosecutors Khairul Azreen Mamat and Nurliyana R Azmi appeared for the prosecution while lawyers N Subramaniam and S Selvantheran represented P Tech Resources Sdn Bhd.
